If the game is written by somebody else and doesn&#039;t use Nintendo&#039;s servers or network service, you should still be able to play the game online even if Nintendo ban you from their network]]></description>

Nintendo states that should they learn you have unauthorised devices/software, they have the right to ban you from services, such as online play. However, I have not heard of anybody being banned as of yet]]></description>
