It's also very easy to make your Wii look legit, especially if you have Bootmii. They caught me when I sent it in due to a bad SD Card slot, back then they didn't care, and I didn't think to myself "Hey, I can use USB" to make it look legit =p

It depends entirely on what you install on your wii. You must remove all homebrew and make sure that there is no mention of homebrew in the play log. The Homebrew Channel only appears in the play log if you launch a channel or game through something that was launched from the Homebrew Channel, but other custom channels always appear in the play log.
