Since when was jailbreaking not legal? Also, homebrew is legal as well so either way Nintendo would take preventative measures. What you're asking really doesn't make sense.Quote

I've read that the FCC made jailbreaking iPhones and other cell phones legal. With this in mind, would it also be possible to do the same with other electronics, as well as the Wii, so Nintendo wouldn't have to try to take us down and get TT to grind their teeth at both fans rushing them and working to counter-act Nintendo's counter?

Well, the FCC also said that customers can do whatever they wanted with the jailbroken device without persecution of any kind from the original provider. If that comes to Wii, with the exception of hardware modification/cIOSes, Nintendo would have to revoke the void warranties.
